Kentucky Case in Appeals Court
It looks like the online casinos in Kentucky will have to wait some more while
their victorious case now goes to the court of appeals. Less than two days after
the Kentucky courtrooms ruled against the claims from Governor Beshear that the
internet domain names were gambling devices. The Kentucky Appellate court ruled
against the Governor and after a moment of silence from Beshear and his legal
team, the whole media circus is back in the court rooms again. They are not
stopping in the Kentucky court rooms. It appears that they are going to take
this case all the way to the Kentucky Supreme Court, according to the Justice
and Public Safety Cabinet. The online casino domains still remain seized.
The seizure of the online casino domains is the same thing as seizing a land
based casino. That is what the lawyer of the online casinos, Mr. Fleischaker
stressed during the trial. There was definitely a healthy dose of skepticism
held by a majority of the judges dealing with the case in regards to the claims
that were being made by the Governor. One of the major points that a judge made
during the trial was when Judge Jeff Taylor asked the prosecution how the
government could seize these online casino domains without first prosecuting the
owners. No matter what is decided in this case it is surely to affect the
internet as a whole, not just in the state of Kentucky. The secretary of the
Justice and Public Safety, J. Michael Brown said, “The evidence demonstrated
that illegal and unregulated activity is occurring in Kentucky, and that
millions of dollars are being lost as a result of that activity, a fact that
wasn’t disputed in Tuesday’s ruling.”
