Kentucky Case Against Golden Casino:1
Everyone know that the online casino industry is no stranger to the United
States courtroom. The Unlawful Internet Gambling Enforcement Act (UIGEA) works
hand in hand with Congress when it regards internet gambling and the controversy
that surrounds it. Usually problems with online casinos and online gambling are
usually kept in the Federal court system. Not in this case...
In the sate of Kentucky, a case was brought to the court system in regards to a
circle of online casinos. This ring of online casinos includes one very popular
online casino, Golden Casino. The problem with the websites is that they are
operating from the United States, illegally. The Kentucky government is trying
to have these websites forfeit their domains, which come to a total of 141. All
of their sites are registered through the domain creator, GoDaddy. Kentucky
wants to take it one step further than that with these online casinos, they want
“retroactive financial compensation”. This would mean that online casinos
operating out of Kentucky would have to pay up to millions of dollars in
penalties.
Some say that the state does not have enough power to bring down the ring of
online casinos and get the financial compensation. A 1974 law allows the state
of Kentucky to seize illegal gambling devices, according to the Kentucky Justice
Secretary J. Michael Brown. And in this particular case the illegal gambling
devices in question are the online casino domain names. The defendants and their
lawyers are trying to maintain that the court has no jurisdiction in this
particular case, they insist that the case should be dismissed.
